All Photographs & Artwork sold on this website are the property of Kristy Ashton and Richard Jackson and under copyright to The Auld Romantics.

Customs and import taxes

Buyers are responsible for any customs and import taxes that may apply. We are not responsible for delays due to customs.

Delivery

Processing time of each product does vary but we aim to dispatch all goods within 3 working days via Royal Mail. All items are free delivery within the UK.

Returns & Cancellations

We do not accept returns or exchanges on our products due to the personalised and made-to-order nature of our items. However, if there is an issue with your order, please contact us within the first instance. Depending on the circumstances, we may offer refunds or store credit. Refunds will be issued for the purchase price minus any shipping costs or store credit will be provided for future purchases. Please note that personalised items, custom orders, and digital downloads are non-refundable.

Commissions

In the following terms & conditions “the photographer” shall mean the Auld Romantics. “The clients” shall be those persons defined on the booking form. These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing.

1. COPYRIGHT
The copyright Designs and Patents Acts assign the copyright of the images to the photographer.

2. DISPLAY
The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, social media etc.

3. LICENSE, COVERAGE AND REPRODUCTION:
• Photographs taken during the course of the shoot will be at the discretion of the photographer although every effort will be made to comply with the clients requirements.
• The photographer shall be granted artistic license in relation to the poses photographed and the locations used. The photographer’s judgement regarding these matters shall be deemed correct.
• Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.
• The nature of our photography demands that we are flexible to the changeable Scottish weather. As such we request that the client(s) fully cooperate(s) with the photographer and must appreciate that last minute changes to the shoot, location or timing on or before the day may occur due to environmental conditions.
• The client(s) understand(s) and accepts that the session will be as the photographers professional expertise determines.

4. PRICES:
All standard shoot prices and additional goods specified on the booking form are supplied at the prices ruling on the date of booking. Goods not specified on the booking form are supplied at the prices ruling at the time of receipt of the order.

5. PAYMENTS:
• A non-refundable booking fee will confirm your booking and the date agreed, as well as full acceptance of the terms and conditions as published on the photographer’s website. A confirmation email will be sent by the photographer on receipt of the booking fee and no other reservations for that time or date will be made by the Photographer.
• The booking fee is 40% of the cost of the shoot and will be deducted when calculating the final balance due.
• Payment in full of the remaining balance will be due at least 7 days in advance of the date of the shoot.
• To provide flexibility to our traveling International clients, a cash payment of the balance can be made on the day of the session, if requested at least 7 days in advance and agreed by email prior to the session.
• Additional goods ordered must be paid for in full at the time of ordering.
• Titles to all goods remains with the photographer until paid for in full by the client(s)

6. FORCE MAJEURE:
• The Photographer shall not be liable to the client for delays or cancellation occasioned by causes beyond the photographers reasonable control and without its fault or negligence, including but limited to, accident, illness, acts of god, acts of war, acts of the government, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather and delays of photographers suppliers. In the event it shall become impossible for the photographer or client to perform their obligations under this contract for reasons of Force Majeure, the parties so unable to perform may terminate this contract upon written notice to the other. In such event clients shall pay the photographer only for work completed, expenses incurred or deposit at the time of termination.

7. OWNERSHIP:
All digital image files remain the property of the photographer. All edited digital image files supplied to the client(s) are for their own non-commercial use only.

8. CANCELLATION:
• If a shoot is cancelled by the client(s), the Booking Fee is non refundable.
• Rescheduling of the session may occur if more than 48 hours notice is given by the client(s), without the requirement of a further Booking Fee.
• We cannot guarantee availability of a rescheduled date at short notice, although we will make every effort to comply with the clients wishes.
• If the client(s) cancel the shoot within 48 hours of commencement, then a new booking will need to be arranged and a further Booking Fee will be payable.

9. PERSONAL ACCIDENT:
Any directions issued to client(s) during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
